Released
on Own Recognizance (OR)
Your attorney will request this type
of release prior to your sentencing.
OR is granted based on your promise
to appear at future court proceedings.
| Eligibility: |
Non
violent offenses with no prior
convictions. You are more likely
to be granted OR if you have strong
community contacts and ties, have
a place to live and a job waiting
for you – these are all
points your attorney should argue
before the judge. |
| Duration: |
Until
sentencing. |
| Cost: |
None. |
| Benefit: |
Can
maintain employment and a fairly
normal life. You will save money
because you will be released versus
having to spend money on bail.
If you are a non-citizen then
each day that you remain in jail
the greater your chance of having
an ICE (Immigration Customs Enforcement)
Hold placed on you and eventually
deported.

Supervised
Own Recognizance (SOR)
Your attorney will request this type
of release if the request for OR is
denied. This type of release means
your behavior is strictly controlled
which can include testing for alcohol
and drug use, warrantless search and
seizure, and stay away orders from
the victim if any. Many other conditions
can apply – ask your attorney.
Failure to meet the strict terms and
conditions may result in you being
returned to jail.
| Eligibility: |
Non-violent
offenses with no prior convictions;
or those defendants who are young
with relatively little criminal
history. |
| Duration: |
Until
sentencing. |
| Cost: |
You
may have to incur some if not
all of the drug and alcohol testing
costs. If you are required to
attend counseling you may need
to pay for it. |
| Benefit: |
Can
maintain employment, live a normal
life, but within the controls
and conditions established by
the court and probation.
